DOJ Fabricated Russia Hoax Crime, Withheld Notes to Force Plea
ATLANTA — Newly declassified agent notes from the Federal Bureau of Investigation (FBI) provide more evidence U.S. Justice Dept. (DOJ) attorneys maliciously prosecuted General Michael Flynn. Robert Mueller, DOJ special prosecutor for the Russia Hoax, claimed Flynn lied to agents about a December 20, 2016 phone conversation with a Russian Ambassador. The charges were based on distorted information in a FD-302 summary prepared by Deputy Assistant Director Peter Strzok. It documents a January 24, 2017 interview Flynn had with Strzok and Special Supervisory Agent Joe Pientka.
The FD-302 misrepresented Flynn’s statements and the FBI agents’ own handwritten notes by falsely claiming the incoming National Security Advisor made 4 to 6 calls to Russian Ambassador Sergey Kislyak on December 20, 2016 but denied making calls. The notes indicate Flynn was truthful about a lawful contact. Deputy Director Andrew McCabe arranged the Flynn interview, which had no admonition and was falsely portrayed as “defensive briefing context” for the CROSSWIND Russia investigation. FBI Director James Comey admitted sending the agents to the interview without proper notice. Comey directed the discredited CROSSFIRE HURRICANE investigation based on URRICAHthe fake Steele Dossier that propagated the Russia Hoax.
The FBI had secretly opened and already completed an investigation of Flynn known as CROSSFIRE RAZOR that found “no derogatory information.” The case closing document had already been prepared on January 4, 2017, when Strzok intervened and texted the case agent to request it remain open. Strzok waited 20 days after the Flynn interview before preparing the FD-302 on February 15, 2017. He received editing assistance from Lisa Page, a Special Counsel to McCabe who was not even present for the interview. Strzok and Page exchanged texts indicating that McCabe and “7th floor” top level FBI directors were involved.
DOJ attorneys withheld exculpatory evidence that could have exonerated Flynn by refusing to provide the FBI agent interview notes while prosecuting him on a bizarre charge under the 1799 Logan Act. They also threatened to prosecute his son for foreign government involvement even though his Flynn Intel Group activities were provided to a Turkish businessman not related to the government. In 2017, Flynn consented to a plea deal for the bizarre charge on advice of his retained law firm, Covington and Burling. He recently said in an interview there was “no way in the world” he would have done that if he had the interview notes.
In 2019, Flynn changed attorneys, withdrew his plea and declined a pardon to fight the injustice. But Judge Emmet Sullivan, who falsely accused Flynn of other crimes during the 2017 hearing, refused to accept the plea withdrawal. In May 2020, when the DOJ motioned to dismiss his plea conviction due to abusive prosecution, Sullivan refused even when a D.C. Circuit panel ordered him to dismiss the case! After the D.C. Court of Appeals denied Flynn’s mandamus, he accepted a pardon from President Trump in November 2020. In June 2025, he sued the DOJ and settled for $1.2 million in March 2026. Flynn, whose story is told in the Flynn movie, said in an interview “they were not after me, they were after President Trump.”
